Long story short: I was told they have a trucking program for 100 K. Signed an agreement and started paying the funds in chunks. I paid a total of $37,000. Then when I asked for more proof of service for other clients as I was figuring out the rest of the money, I found out that they were pretty much lying to me for the service they said they could provide. I asked for my money back and they wouldn’t give me my money back and instead, trying to force me to transfer it to another service. I said no and I want my money back. There now saying that my $37,000 is nonrefundable due to the contract.

After talking to a lawyer who looked at the contract, we find out that contract states that “The Payment“ is nonrefundable. What is defined as “The Payment” is $100,000. In other words, $100,000 is nonrefundable. $100,000 was not paid. What was paid was $37,000. $37,000 does not constitute as “The Payment” according to this contract. Therefore, the $37,000 is not bound by this contract and the contract was never consummated, because the payment was never paid in full.

After finally, getting in contact with Mike after over four months of emails, he agrees that I would get a refund of my $37,000, but then of course disappears.

Do I have a case? They basically took my money and didn’t even start services because the services were never paid in full.

Any information on where to find this guy and sue? Any success suing him?
